- Exception A: An Aboriginal & Torres Strait Islander (ATSI) student who does not live or work in NSW but lives in specific defined interstate NSW border areas are eligible for government-subsidised training under Smart and Skilled (as defined in the list set out in the Smart and Skilled Operating Guidelines.

- A student must have left school in adherence with the NSW School Leaving Age Policy and the NSW Education ACT 1990 and the NSW Education Amendment (School Leaving Age) Regulation 2009.
- Exception B: Excluding home school students, registered by the NSW Education Standards Authority.

- A Disadvantaged Student is a student who is one of the following: (i) a Australian Aboriginal or Torres Strait Islander; (ii) someone with a disability or is the dependent child, spouse or partner of someone with a disability; (iii) a recipient of an Applicable Benefit, or is dependent child, spouse or partner of a recipient of an Applicable Benefit (see the table below for a list of Applicable Benefits); (iv) someone who is experiencing significant hardship as verified by a government agency, medical professional or relevant support agency; or (v) someone who has English as an additional language and who is unable to effectively participate in the community or in employment. Applicable Benefits: Commonwealth Benefits and Allowances include: Age Pension, Carer Payment, Farm Household Allowance, Jobseeker Payment, Special Benefit, Veteran’s Children Education Scheme, Widow Allowance, Austudy, Disability Support Pension, Family Tax Benefit Part A (maximum rate), Parenting Payment (Single), Veterans’ Affairs Pensions, and Youth Allowance.
- A regional/remote student is a student who is not a disadvantaged student, and lives or works in a regional or remote location and cannot effectively access training under a Smart & Skilled Entitlement Program or other Program. - A small business is defined as a business with: (a) 20 employees or less; or (b) an annual turnover of less than $2,000,000.
